RIM Loses Request for Stay in NTP Suit


Research In Motion Ltd. lost its bid to halt proceedings in a patent-infringement lawsuit while it appeals the case to the U.S. Supreme Court. Trading was halted after shares fell as much as 10 percent. The U.S. Court of Appeals for the Federal Circuit rejected the company’s request to prevent the case from returning to the trial court, where it faces a possible court order to halt the BlackBerry service in the U.S. The appeals court had upheld most of a patent-infringement finding in favor of NTP Inc.

Research In Motion had asked the appeals court to stop any further proceedings in the case while the appeal is filed. The case returns to the trial judge in Richmond, Virginia, where Research In Motion is expected to ask the court to force NTP to abide by an agreement reached in March to settle the case for $450 million. The settlement collapsed in a dispute over the scope of the licensing agreement.
