[...] Just two days into the new year, and already RIM is headed back into the courtroom - this time in an intense battle with Roy G. Biv. Similar to the Samsung BlackJack lawsuit, this one is also over the term “black”, reports Brighthand. This suit comes at the heels of Mr. Biv’s announcement that he will be launching his own smartphone with a Windows Mobile OS. ‘…RIM’s frivolity shows no bounds. Shortly after the suit involving Mr. Biv, RIM filed against Lewis Black, Black Sabbath, Black Eyed Peas, black holes, and Johnnie Walker Black Label. It’s unlikely the train will stop there as lead internal counsel for RIM said, “You liberal media types vilify big business all the time. We’re just protecting our brand. Expect more lawsuits to come as we protect our berry patent. Strawberry Shortcake has been riding our coattails for years.”‘ [...]

There is no doubt that some will confuse the names and purchase a BlackJack thinking it to be a BlackBerry. In fact, I do believe that one factor in the choice of name for the BlackJack was due to its similarity with BlackBerry. If you read the source article you will see that this is not the first time that Samsung is in trouble for ripping off a name.

Let's also remember that the Cingular salespeople will be of little help to clear up this confusion. There are probably more than a few salespeople themselves who think the BlackJack to be a BlackBerry.

That being said, I don't see how RIM can win this one. In essence, they are staking claim to every name that begins with the word "black" and I don't see how they can do that.

However, sometimes in the corporate world you fire a warning shot, and this may be the case.

If you read the source article you will see that this is not the first time that Samsung is in trouble for ripping off a name.

Let’s also remember that the Cingular salespeople will be of little help to clear up this confusion. There are probably more than a few salespeople themselves who think the BlackJack to be a BlackBerry.

That being said, I don’t see how RIM can win this one. In essence, they are staking claim to every name that begins with the word “black” and I don’t see how they can do that.

However, sometimes in the corporate world you fire a warning shot, and this may be the case.

oh, come on! Now you're expecting people to READ the box! Next, you'll actually ask them to read the user's manual. I guess that's ok....as long as you don't get freaky and expect them to research what they're buying.

BTW, can I have your 8700 if the Pearl rolls your way? ;-)
