Samsung’s device is almost identical in size, weight and look to the BlackBerry Pearl smart phone, RIM said.

If they wanted to TM the word “black” they could have. Truth is BlackJack is stellar, and with Exchange SP2 pushing email it is the closest thing to the Blackberry experience yet. Maybe RIM is actually worried that the competition is getting real, and the value of the middleware is diminishing?

There is no doubt that some will confuse the names and purchase a BlackJack thinking it to be a BlackBerry. In fact, I do believe that one factor in the choice of name for the BlackJack was due to its similarity with BlackBerry. If you read the source article you will see that this is not the first time that Samsung is in trouble for ripping off a name.

Let’s also remember that the Cingular salespeople will be of little help to clear up this confusion. There are probably more than a few salespeople themselves who think the BlackJack to be a BlackBerry.

That being said, I don’t see how RIM can win this one. In essence, they are staking claim to every name that begins with the word “black” and I don’t see how they can do that.

However, sometimes in the corporate world you fire a warning shot, and this may be the case.
